Electronic Visit Verification (EVV)


In accordance with Section 12006(a) of the 21st Century Cures Act (the Cures Act), states are required to implement EVV for personal care services and home health care services that require an in-home visit by a provider.  EVV implementation for regional center personal care services began January 2022.

Electronic Visit Verification (EVV) is an electronic record of a service being delivered.  EVV is a new federal requirement for personal care and home health care services that participants receive in their homes.  The federal requirement was put into place to make sure people are getting the services they need.

In SDP the vendor, agency, company or person who is the employer of record (EOR) for the direct care staff person is responsible for EVV compliance.

The Department of Developmental Services (Department) has identified the regional center personal care services subject to EVV in SDP as:
  1. 320 Community Living Supports
  2. 313 Homemaker
  3. 310 Respite

If you are the employer of record (Bill Payer Model) for a direct care staff, you are a company or business and your services are provided in the participant’s home, connect with the FMS you work with for your participants.

  • The FMS has an agreement for you to sign and return to them which also provides you with information you’ll need.
  • You will go to the ‘Provider’ tab at https://www.dds.ca.gov/services/evv/ and follow the steps and use the tools there to self-register and complete on-boarding as a provider.

FREQUENTLY ASKED QUESTIONS

How does EVV work for bill payer services?

For services where a vendor, agency or company is the EOR for the staff providing the services, the vendor, agency or company will assure EVV compliance for those services; they will select the  EVV system, will assure EVV visit data is complete (participant UCI, service code, etc.) and that the data is linked to the FMS vendor number under which it is billed to the regional center.

How do I get the participant UCI, service code and FMS vendor number to use for EVV?  The FMS is able to provide the information needed. 

Isn’t this sensitive information to share? Yes. But it is also required as part of EVV compliance.  EORs who receive and use any sensitive information for their EVV compliance will agree to only use this information for EVV.

Failure to comply with EVV requirements may result in fines and sanctions. Vendors could also be required to repay any Medicaid funds received if DDS determines the vendor is not compliant.
